EITI in Ukraine
Ukraine joined the Extractive Industries Transparency Initiative (EITI) in 2013 and starting from 2015 publishes the annual EITI Reports, where provides the following information: how many extractive companies operate in Ukraine, what amount of taxes these companies have paid to the state as well as shows which companies are ready to disclose data on their operations and which aren’t. An Independent Administrator, an independent company with relevant experience, is selected to prepare the Report and reconcile the data on extractive companies’ payments to the state. Three National EITI Reports of Ukraine have already been published. These reports analyze extractive industry of Ukraine in the period from 2013 to 2016. The preparation of the fourth EITI Report, which will describe the development of extractive industries in 2017, has already started. According to the Resolution of the Cabinet of Ministers of Ukraine No. 1098 dated September 30, 2009, the Ministry of Energy and Coal Industry of Ukraine is responsible for the implementation of the Extractive Industries Transparency Initiative in Ukraine. The EITI report consists of two parts: contextual information and payments reconciliation. Contextual information includes: general information about the industry, the largest reserves of minerals, which are included to the scope of the Report, the volumes of minerals production, information about subsoil areas and granted special permits, role of extractive industries in the economy of Ukraine, their normative and fiscal regulation, functions of state authorities, etc. A part on payments reconciliation provides detailed information on the types and amounts of payments paid by the extractive companies. Ministry of Energy and Coal Industry of Ukraine is responsible for EITI implementation and EITI Reports preparation in Ukraine. National EITI Secretariat was established in 2015 in order to coordinate EITI implementation in Ukraine. The members of Secretariat are selected through an open tender conducted by the Ministry of Energy and Coal Industry of Ukraine. The Secretariat performs the following functions: coordinates the process of EITI reports preparation, works with an Independent Administrator, organizes MSG activities, maintains relations with reporting entities, organizes and coordinates cooperation with international financial institutions, donors and the International EITI Secretariat, ensures implementation of UAEITI communication strategy and coordinates the work with the regions. Currently, the main task of the Secretariat is to prepare and publish the fourth National EITI Report of Ukraine. A national multi-stakeholder group (MSG) decides how the EITI process in their country should work. MSG controls the process of EITI Reports preparation and ensures the compliance with the EITI Standard requirements. MSG includes representatives of government, companies and civil society in an equal number of 8 people. MSG is accountable to the Cabinet of Ministers of Ukraine. Sessions of the MSG are held not less than 4 times a year, decisions are taken by consensus. The activity of the MSG is based on the principles of free discussion of issues and decision-making, transparency, compliance with the norms of Ukrainian legislation and the rules of the EITI Standard. In accordance with Article 13 of the Constitution of Ukraine, subsoil and natural resources located within the territory of Ukraine, the natural resources of its continental shelf, the exclusive (maritime) economic zone are objects of the property rights of the Ukrainian people. On behalf of the Ukrainian people, the rights of the owner are exercised by state authorities and local self-government bodies within the limits defined by the Constitution. More detailed information on the legislation governing minerals extraction in Ukraine can be found in the chapter “Overview of the regulations applicable to extractive industries” of the EITI Report. Law of Ukraine №2545-VIII "On Ensuring Transparency in Extractive Industries" has been developed in order to open the data about extractive activities in Ukraine and make them publicly available. Information about companies’ payments to state and local budgets, volumes of minerals extraction, a list of mining projects, etc. will be open. The law defines the subject, methods, terms and procedures for disclosure of information on extraction in Ukraine. It also specifically provides for liability for violations of the legislation on disclosure of information, in particular for failure to submit or submission of inappropriate data. activity is to unite the efforts of civil society to cooperate with authorities and extractive companies for
the effective natural resources governance and preservation of the environment. Only members of
Association “Energy Transparency” can represent civil society in EITI multi-stakeholder group in Ukraine.
